This Privacy Policy describes how Marcovici Holdings LLC and its subsidiaries, affiliates, and related entities (collectively, "Company," "we," or "us") collect and process personal information of visitors who access or interact with our website at www.ilovejacks.com ("Website") that links to this Privacy Policy, as well as other personal information about our customers. This Website, our restaurants, and our related goods and service offerings are referred to in this Privacy Policy as our "Services." The California Consumer Privacy Act, as amended by the California Privacy Rights Act ("CCPA") requires us to provide our consumers with a privacy policy that contains a comprehensive description of our online and offline practices regarding our collection, use, sale, sharing, and retention of their personal information, along with a description of the rights they have regarding their personal information. This Privacy Policy provides the information the CCPA requires, together with other useful information regarding our collection and use of personal information. Any terms defined in the CCPA have the same meaning when used in this Privacy Policy.

This Privacy Policy applies to your use of the Website. This Privacy Policy does not apply to any websites or facilities operated by third parties. 1. Information Collected

We collect and use information that identifies, relates to, describes, references, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household ("personal information"). Personal information does not include:

• Publicly available information, including from government records, through widely distributed media, or that the consumer made publicly available without restricting it to a specific audience.

• Lawfully obtained, truthful information that is a matter of public concern.

• Deidentified or aggregated consumer information. We may collect, use, share, transfer, and otherwise process de-identified and aggregated information that we receive or create for any purpose at our sole discretion, in compliance with applicable laws. We are the sole and exclusive owner of such de-identified and aggregated information, including if we de-identify personal information so that it is no longer considered personal information under applicable laws.

We do not collect any sensitive personal information. 

Children's Personal Information

The online Services are not intended for, and are not intentionally targeted to, children under 13, and we do not knowingly request or seek to collect personal information from any person under 13 years of age through the Services. If we learn that the online Services have received personal information directly from a child who is under the age of 13, we will delete the information in accordance with applicable law.

Individuals who indicate they are under the age of 16 will not receive marketing emails, text messages, push notifications, personalized marketing, personalized experience, or have their personal information sold or shared with non-service provider third parties unless they opt in/consent to these respective options.

We obtain the categories of personal information listed above from the following categories of sources:

• Directly from you, such as when you visit one of our restaurants, sign up for special offers, send us an email or online message, submit your credit card or other payment information when ordering and purchasing goods and services. 

• Indirectly from you, such as from your interactions with the Website. 

• From our service providers, such as order fulfillment providers and data analytics providers.

Ordering Online

If you place an individual or group order through our Website, you will be asked to provide your first and last name, email address, phone number, and payment information. If you place an order for delivery, you will be asked for the physical address you would like the order delivered to. We may also offer you the ability to order through a third-party food delivery service, in which case we obtain your information from the third party in order to fulfil your order.

Contact Us

When you contact us with a comment, question or complaint, you may be asked for information that identifies you, such as your name, address and a telephone number, along with additional information we need to help us promptly answer your question or respond to your comment.  

Information Collected Automatically

When you use our Website, we and our third-party service providers may automatically collect information about how you access and use the Website and information about the device you use to access the Website. We typically collect this information through a variety of tools and technologies such as cookies, including Google Analytics, Google Ads, DoorDash Storefront, and Yelp Reservations, to enable data recording and indexing, and similar technology (collectively, "tracking technologies"). We and our third-party partners may automatically collect information such as:

• Internet Protocol address

• Browser ID and type

• Domain names

• Referring website addresses

• Page analytics (for all pages, who visits, how long, and average engagement time per session)

• Active users by country, city, and language

• Traffic acquisition to determine whether you visited our Website due to an organic search, directly, through a referral, organic social media use, or otherwise

• Total users

• New users

• Sessions

• Views per session

• Average session duration

• Active users by operating system, platform or device, browser, screen resolution, and device category (i.e. mobile, desktop, tablet)

This information is used for the operation of our business, to maintain quality of the goods and services we offer, and to provide general statistics regarding the use of the Website.

Our service providers and other third parties may share your personal information with us. For example, if you order food online, you may submit personal information to one or more third parties that may share your information with us.

We may combine information that we collect from and about you. When you submit information to a third party, you are subject to that third party's terms of use and privacy policies, for which we are not responsible.

Personal Information Collection, Use, and Disclosure Purposes

We may use and disclose the personal information we collect to advance the Company's business and commercial purposes, specifically to:

• Communicate with you regarding our restaurants and other Services;

• Respond to your requests or inquiries;

• Process payment information for online food orders;

• Maintain healthy and safe conditions in our restaurants;

When we collect, process, or disclose aggregated or deidentified consumer information, we will maintain and use it in deidentified form and will not to attempt to reidentify the information, except to determine whether our deidentification processes satisfy applicable legal requirements.

4. Retention of Personal Information

We will retain your personal information for as long as necessary to fulfill the purposes described in this Privacy Policy, unless otherwise required by applicable laws. Criteria we will use to determine how long we will retain your personal information include: whether we need your personal information to provide you with our Website or other Services; you have requested information from us; we have a legal right or obligation to continue to retain your personal information; we have an obligation to a third party that involves your personal information; our retention or recordkeeping policies and obligations dictate that we retain your personal information; or we have another business purpose for retaining your personal information.

5. Disclosing, Selling, or Sharing Personal Information

Business Purpose Disclosures

We may disclose the personal information we collect to third parties for the above-mentioned business purposes. We only make these business purpose disclosures under written contracts that describe the purposes, require the recipient to keep the personal information confidential, prohibit using the disclosed information for any purpose except performing the contract, and meet the CCPA's other contract requirements for engaging service providers or contractors. 

We may disclose your personal information to our vendors and other third-party service providers, such as credit card processors and website hosts, that help us provide the Services, support features on our Website or in the restaurants, or otherwise market our Services.

We may disclose personal information: if we are required to do so by law, legal process, statute, rule, regulation, or professional standard, or to respond to a subpoena, search warrant, or other government official requests; when we believe disclosure is necessary or appropriate to prevent physical harm or financial loss; in connection with an investigation of a complaint, security threat, or suspected or actual illegal activity; in connection with an internal audit; or in the event that the Company is subject to mergers, acquisitions, joint ventures, sales of assets, reorganizations, divestitures, dissolutions, bankruptcies, liquidations, or other types of business transactions. In these types of transactions, personal information may be shared, sold, or transferred, and it may be used subsequently by a third party.

Selling or Sharing Personal Information

During the last 12 months, we sold or shared (as these terms are defined under CCPA) commercial information (transaction data), and internet or other network or device activity (like an Internet Protocol address and record of a browser's visit to our Website) for marketing and advertising purposes to advertising providers and analytics companies. 

Our personal information sales and/or sharing does not include information about consumers we know are under age 16.

6. Your Rights and Choices 

If you are a California resident, the CCPA grants you the following rights regarding your personal information: 

Right to Know and Data Portability Requests

You have the right to request that we disclose certain information to you about our collection and use of your personal information (the "right to know"), including the specific pieces of personal information we have collected about you (a "data portability request"). You may exercise your right to know twice in any 12-month period. Once we receive your request and confirm your identity (see How to Exercise Your Rights), we will disclose to you:

• The categories of:  

• personal information we collected about you; and

• sources from which we collected your personal information.

• The business or commercial purpose for collecting your personal information and, if applicable, selling or sharing your personal information.

• If applicable, the categories of persons, including third parties, to whom we disclosed your personal information, including separate disclosures identifying the categories of your personal information that we:

• disclosed for a business purpose to each category of persons; and

• sold or shared to each category of third parties.

• When your right to know submission includes a data portability request, a copy of your personal information, subject to any permitted redactions.

Right to Delete and Right to Correct

You have the right to request that we delete any of your personal information that we collected from you and retained, subject to certain exceptions and limitations (the "right to delete"). Once we receive your request and confirm your identity, we will delete your personal information from our systems unless an exception allows us to retain it. We will also notify our service providers, contractors, and other recipients to take appropriate action.

You also have the right to request correction of personal information we maintain about you that you believe is inaccurate (the "right to correct"). We may require you to provide documentation, if needed, to confirm your identity and support your claim that the information is inaccurate. Unless an exception applies, we will correct personal information that our review determines is inaccurate and notify our service providers, contractors, and other recipients to take appropriate action.

Personal Information Sales or Sharing Opt-Out and Opt-In Rights

You have the right to request that businesses stop selling or sharing your personal information at any time (the "right to opt-out"). Similarly, the CCPA prohibits businesses from selling or sharing the personal information of consumers it actually knows are under 16 years old without first obtaining consent from consumers who are between 13 and 15 years old or the consumer's parent or guardian for consumers under age 13 (the "right to opt-in").

ADMT Rights

When a business uses automated decision-making technology ("ADMT") to make significant decisions about you, you may have rights to:

• Obtain certain information about how the business uses ADMT, that is specific to you.

• Opt-out of the ADMT use unless the business provides you with a method to appeal the decision to a human reviewer with the authority to overturn the decision or another exception applies.

We do not currently use ADMT to make significant decisions about consumers, so we do not provide ADMT access, opt-out, or appeal rights.

Right to Non-Discrimination

You have the right not to be discriminated or retaliated against for exercising any of your privacy rights under the CCPA.

California "Shine the Light" Rights

Subject to certain limitations under California's Shine the Light law, California residents may contact us as described at the end of this Privacy Policy to request a list of third parties to whom we disclosed certain personal information for those third parties' direct marketing purposes during the preceding year. The information we will provide will describe our general practices in the prior calendar year and will not be specific to you. 

Your request should indicate that you are a California resident, and you must provide your full current California address, where we will send our response. Your inquiry must specify "Shine the Light Request" in the subject line of the email or the first line of the letter, and include your California address. We are only required to respond to one such request per individual each year.  We may take reasonable steps to verify your identity and the authenticity of the request.

7. How to Exercise Your Rights

Exercising the Rights to Know, Delete, or Correct

To exercise the right to know (including data portability), delete, or correct described above, please submit a verifiable request to us to info@ilovejacks.com.

Please describe your request with sufficient detail so we can properly understand, evaluate, and respond to it. You or your authorized agent may only submit a request to know, including for data portability, twice in a 12-month period.

Exercising the Right to Limit or, Opt-Out

You can submit your request to limit or, opt-out to: info@ilovejacks.com. 

You can also submit your request to opt-out of personal information sales and sharing by clicking on the "Do Not Sell or Share My Personal Information" button on the Website homepage. 

Verification Process and Authorized Agents

Only you, or someone legally authorized to act on your behalf, may make a request to know, delete, or correct related to your personal information. We may request specific information from you or your authorized representative to confirm your or their identity before we can process your right to know, delete, or correct your personal information. 

We cannot respond to your request to know, delete, or correct if we cannot verify your identity or authority to make the request and confirm the personal information relating to you. 

For requests to limit or opt-out, we ask for the information necessary to complete the request, which may include, for example, the consumer's name and email address.

Responding to Your Requests to Know, Delete, or Correct

We will confirm receipt of your request within ten business days. If you do not receive confirmation within the ten-day timeframe, please contact info@ilovejacks.com.

We endeavor to substantively respond to a verifiable request within 45 days of its receipt. If we require more time (up to another 45 days), we will inform you of the reason and extension period in writing. We will deliver our written response to your verified email address. Our substantive response will tell you whether or not we have complied with your request. If we cannot comply with your request in whole or in part, we will explain the reason, subject to any legal or regulatory restrictions. Applicable law may allow or require us to refuse to provide you with access to some or all of the personal information that we hold about you, or we may have destroyed, deleted, or made your personal information anonymous in compliance with our record retention policies and obligations. 

Any disclosures we provide will cover information for the 12-month period preceding the request's receipt date. 

For data portability requests, we will select a format to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance.

We do not charge a fee to process or respond to your verifiable request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request. 

Response and Timing on Rights to Limit or Opt-Out

In response to your request to limit or opt-out, we will process your request within the time required by applicable law. We will only use personal information provided from your request to comply with the request.

We may deny opt-out requests if we have a good-faith belief that the request is fraudulent and will clearly explain our denial decision to the requestor.

Once you make a request to limit or opt-out, we will wait at least 12 months before asking you to reauthorize personal information sales or sharing. 

Reselling or Resharing Personal Information

The CCPA prohibits a third party from reselling or resharing personal information unless you have received explicit notice and an opportunity to opt-out of further sales or sharing. 

8. How We Protect Your Personal Data

We use commercially reasonable administrative, physical, and technical measures designed to protect your personal data from accidental loss or destruction and from unauthorized access, use, alteration, and disclosure. However, no website, mobile application, system, electronic storage, or online service is completely secure, and we cannot guarantee the security of your personal data transmitted to, through, using, or in connection with the Services. In particular, email, texts, and chats sent to or from the Services may not be secure, and you should carefully decide what information you send to us through these communications channels. Any transmission of personal data is at your own risk. 

The safety and security of your information also depends on you. You are responsible for taking steps to protect your personal data against unauthorized use, disclosure, and access.

We provide a variety of services on our Website using cookies. We place cookies on your device to provide you with personalized access to essential services, enhance functionality, and show you offers and services tailored to your interests. We are not responsible or liable for, or able to monitor or control, the content, activities, practices, or policies of these linked sites or third parties. We urge you to read the privacy policies of other websites before submitting any information to those websites. Please be aware that to submit job application materials online to work with us, you will be redirected from our Website to a website operated by our third-party service provider. You may be required to create an account with that provider. We encourage you to review the terms and privacy policy posted on that provider's website since this Privacy Policy does not govern your use of that website.
